Establish eligibility before marketing the property

Gather acquisition records, adjusted basis, depreciation and evidence of business or investment use. Personal residences and property held primarily for sale raise different issues and should not simply be called exchange property. Mixed use, entities, debt and related parties can complicate the transaction. Compare an ordinary taxable sale with the proposed exchange and identify what benefit, ongoing obligation and additional cost the exchange actually creates.

Put the exchange structure in place first

For a deferred exchange, discuss the qualified intermediary and restrictions on actual or constructive receipt of funds before the sale closes. An ordinary sale followed by buying another property is not automatically an exchange. Review who holds proceeds, the written agreements and safeguards for the funds. Ask how cash, debt relief or nonqualifying property will affect recognized gain. Do not infer the tax result from exchanging properties of similar asking prices.

Track deadlines and carry forward the tax file

The standard deferred-exchange rules generally require identification within 45 days and receipt within 180 days or the return due date, including extensions, if earlier. Identification must meet the applicable requirements; keep a dated written record and have the adviser verify the exact calendar. Review current relief if an exceptional event applies rather than assuming an extension. Retain the exchange documents and Form 8824 records because deferred gain and basis can affect the later disposition.
